Come on ACCC this is getting rediculous!

Apple have unbeleivibly one an appeal to the lifting of an injunction to stop Samsung selling the Galaxy tab in Australia.

This is getting beyond a joke, Samsung would be up for huge damages against Apple and should already start, The ACCC should be stepping in here on claims of anti-compeditive behaviour.

It’s about time all this BS stopped and Apple swollow their pride and admmit they did not invent the world and they cannot claim patents for everything. This just pisses me off to be quite honest.

I’ll put $100 on the High Court judges using Apple devices and rulling in favour of their favourite!

Motorola wins out against Apple

Motorola have filed for and won and injunction against Apple in German courts this week.
“This is a procedural issue and has nothing to do with the merits of the case,” Apple spokeswoman Kristin Huguet said on Monday. “It does not affect our ability to sell products or do business in Germany at this time.”
Apple had already made the remark that Motorola should not be allowed to proceed as they would be unable to represent the case while in a merger with Google after they aquired Motorola Mobility recently.
The German court obviously thought differently and ruled that Apple may not sell two products that infringe on two of Motorola Mobility patents or face a fine of up to 250k euros.

Samsung trying to block iPhone in Japan and Australia

Go Samsung! I for onew hope they get this but i doubt it as most if not all of the regulators are probably biased due to using an Apple product 😛

It’s about time Apple are taught a lesson and are forced to be more civil in competition rather than trying to bully and subdue healthy (and for the most part better quality) competition.

“Statement from Samsung Electronics Australia

Samsung Electronics today filed preliminary injunction motions in the Tokyo District Court, Japan and in the New South Wales Registry, Australia requesting the courts to stop the sale of Apple’s iPhone4S in the respective countries.

In a separate filing today, Samsung has appealed the Australian court’s decision on October 13 to grant a preliminary injunction over the GALAXY Tab 10.1.

In Japan, Samsung is also seeking an injunction to immediately bar the sale of iPhone4 and iPad2.

The injunction request in Japan cites infringements on one High Speed Packet Access (HSPA) standard-related patent and three user interface patents, which seriously violate Samsung’s intellectual property.

Samsung’s preliminary injunction request in Australia cites three patent infringements related to wireless telecommunications standards, specifically Wideband Code Division Multiple Access (WCDMA) and HSPA.

In light of these violations, Samsung believes the sale of such Apple devices should be injuncted.

Apple has continued to violate our patent rights and free ride on our technology. We will steadfastly protect our intellectual property.

Patent Claims in Japan:

1. One HSPA patent which relates to a method for deciding amount of power consumption during data transmission

2. Three user interface patents that are essential for displaying information on the screen, specifically UIs for the “in flight mode” indicator (airplane icon); for customizing a Smartphone’s home screen; and for browsing applications categorized in a tree structure (in an apps store).

Patent Claims in Australia:

1. Method and apparatus for transmitting/receiving packet data using pre-defined length indicator in a mobile communication system (WCDMA)

2. Method and apparatus for data transmission in a mobile telecommunication system supporting enhanced uplink service (HSPA)

3. Method and apparatus for transmitting and receiving data with high reliability in a mobile communication system supporting packet data transmission (HSPA).

It seems that the earlier news of Apple blocking the Galaxy Tab 10.1 from being sold in Australia isn’t quite accurate as new information comes to light…

“From Samsung: Apple Inc. filed a complaint with the Federal Court of Australia involving a Samsung GALAXY Tab 10.1 variant that Samsung Electronics had no plans of selling in Australia. No injunction was issued by the court and the parties in the case reached a mutual agreement which stipulates that the variant in question will not be sold in Australia.

A Samsung GALAXY Tab 10.1 for the Australian market will be released in the near future.

This undertaking does not affect any other Samsung smartphone or tablet available in the Australian market or other countries.

Samsung will continue to actively defend and protect our intellectual property to ensure our continued innovation and growth in the mobile communication business.”
